Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Watermarquee (the “Service”), operated by E Four Pty Ltd (“Watermarquee”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Watermarquee provides tools to watermark, protect, and prepare images and short-form video for the web, including free in-browser photo watermarking and paid features such as video watermarking, batch processing, brand kits, AI alt text, background removal, and upscaling. We may add, change, or remove features over time.
2. Accounts and eligibility
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 years old to use the Service.
3. Subscriptions and billing
- Paid plans (such as Plus) are billed in advance on a monthly or annual basis through Stripe, and renew automatically until cancelled.
- You can cancel any time from your dashboard. On cancellation you keep access until the end of the current billing period; we do not prorate partial periods except where required by law.
- Prices are shown on our pricing page. We may change prices, but changes will not affect your current billing period.
- Original Member benefits. Eligible legacy customers retain free watermarking and any applicable standing discount. These benefits are tied to the account’s registered email and are non-transferable.
4. Refunds
We offer a 14-day refund window on new Plus subscriptions. If you’re not satisfied, email hello@watermarquee.com within 14 days of your initial charge for a full refund. This does not limit any non-waivable statutory rights you may have, including under the Australian Consumer Law.
5. Your content and rights
- You retain all rights to the images and video you upload or create with the Service. We claim no ownership of your content.
- You grant us a limited licence to process your content solely to provide the Service (for example, to watermark, store, or run AI processing you request).
- We do not use your content to train AI models, and we do not sell it. See our Privacy Policy for how content is handled.
- Files you have already exported are yours to keep — access to them does not depend on an active subscription.
6. Acceptable use
You agree not to use the Service to:
- Upload or process content you do not have the right to use, or that infringes others’ intellectual property.
- Process unlawful content, or content that is abusive, or that depicts the exploitation of minors.
- Remove or alter watermarks or ownership information on content you do not own.
- Attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the Service.
We may suspend or terminate accounts that violate these rules.
7. Service availability
We work to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, and we may perform maintenance or make changes that temporarily affect availability.
8. Limitation of liability
To the maximum extent permitted by law, Watermarquee will not be liable for any indirect, incidental, or consequential damages, or loss of data, profits, or content, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including the Australian Consumer Law.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination, the provisions that by their nature should survive (such as content ownership, liability, and refunds) continue to apply.
10. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law rules. Any disputes will be subject to the courts of Australia, unless applicable law requires otherwise.
